Buying in Whistler? Why Zoning Matters More Than You Think.

For many buyers looking to purchase a property in Whistler it’s about more than finding the perfect mountain retreat it's about finding the perfect mountain investment. With Whistler being a resort community, properties can have many different uses — from full-time residence to vacation rentals, rental pool properties, or a combination of residential and tourist accommodation.

Two properties that look remarkably similar on the surface can have very different rules around how they can be used, whether they can be rented short-term, long-term, or not at all, and what restrictions may apply to the owners. 

All this to say zoning matters

Understanding how a property is permitted to be used before buying can help buyers choose an ownership opportunity that actually fits their ownership goals.

What Do You Want Your Whistler Property to Do for You?

Before getting into zoning, it can be helpful to start with a more personal question:

How do you want to own in Whistler?

Your answer will influence the type of property that makes the most sense for you to purchase.

A place to call your own.

If your priority is intended for personal use, there are properties zoned for residential living. These can be an excellent fit if you want a place to call home or spend weekends, holidays and extended stays with family and friends. Residential zoned properties do not allow for short-term (less than 30 days) rentals.

It's important to understand that while Whistler is a resort community that doesn't automatically mean all property can be rented to short-term visitors. In Whistler, residentially zoned properties cannot be used for tourist accommodation.

A vacation property that earns income

For some buyers, rental income is an important part of the ownership equation. Whistler has properties specifically zoned for tourist accommodation, allowing owners to rent to visitors when they aren't using the property themselves, subject to the applicable requirements.

This can be an attractive option for buyers who want both a Whistler getaway and the opportunity to generate income.

Zoning is the starting point, but title covenants, strata rules, rental agreements and licensing requirements can also affect what is permitted, due diligence is particularly important when reviewing all of these pieces.

The best of both worlds

For buyers who want personal enjoyment combined with rental potential, some properties offer a combination of residential and tourist accommodation uses.

Whistler also has a number of properties operating within rental-pool structures, including the familiar Phase 1 and Phase 2 models. Phase 1 covenant properties allow for unlimited owner usage as well as monthly leasing and nightly rentals while Phase 2 covenant properties allow for 56 days of owner usage a year (28 days in winter/28 days in summer) with the property being part of a rental pool for the remainder of the year.

These ownership structures can offer different balances of personal use and rental income, so it's important to understand the specific restrictions and owner-use provisions attached to the property you're considering.

The key takeaway? The ability to rent a property doesn't necessarily mean unlimited personal use — and personal use doesn't necessarily mean you can rent whenever you choose.

A longer-term investment

For buyers thinking beyond how they'll use a property today, zoning can also be important from an investment perspective.

Depending on the property, zoning may influence permitted uses, density, development opportunities and future redevelopment potential.

This can be particularly relevant if you're purchasing a property with the intention of renovating, expanding or redeveloping in the future.
